Dicamba – Calls Needed to Congressional Delegation on 9th Circuit Court of Appeals Decision
The American and Missouri Soybean associations urge you to call your members of Congress or relevant staff as soon as possible today, June 5, and ask them to immediately urge EPA to protect farmers and develop options for continued application of dicamba products. EPA has yet to issue guidance on how it will respond to the ruling, so this window is critical and why we are asking you to call rather than submit a letter.

This week’s ruling from the 9th Circuit Court in which application appears to be prohibited immediately was unprecedented since court vacaturs of registrations regularly do not take effect immediately – there is usually a minimum 14-day procedural window or longer before an order takes effect. With this ruling, farmers who have invested hundreds of millions of dollars in seed and product have been ordered to immediately cease use, causing significant harm to farmers during the critical planting season. EPA needs to immediately offer guidance and remedies to farmers that will protect them from this damaging, misguided ruling.
